civil partnership dissolution process

What is Civil Partnership Dissolution?

Civil partnership dissolution is the legal process used to formally end a registered civil partnership. You can apply to dissolve your civil partnership if this has been registered for at least one year. The process is very similar to divorce and requires making an application to the court, accompanied by a court fee of £612.

To successfully dissolve your civil partnership, you must demonstrate that the relationship has irretrievably broken down. The respondent will be required to complete a response form, and a statutory waiting period of 20 weeks applies from the date of issue of the application to court. After 20 weeks, and proving a response has been received, you will be able to apply for conditional order. After a further six weeks you can then apply for the final order, which legally ends the civil partnership.

At Poole Alcock, we are committed to providing professional legal support throughout your civil partnership dissolution. Our experienced solicitors will ensure you are fully informed at every stage, helping you to protect your interests, assets, and future.

Civil Partnership Dissolution FAQs

How much will a civil partnership dissolution cost?

Aside from the court fee of £612, the total cost will depend on the complexity of your situation. At Poole Alcock, we offer clear, transparent pricing and will discuss costs with you upfront during your free initial consultation.

What happens if my partner disagrees with the dissolution?

It is not possible to ‘defend’ an application to dissolve a civil partnership, however, there are limited circumstances where the application can be disputed. If your ex-partner does not agree that the partnership has ended, this can cause practical difficulties in relation to ensuring that the application is responded to. Our expert family law solicitors will guide you through the necessary steps to progress your application.

Can we agree on financial matters without going to court?

Yes, many couples are able to reach a financial settlement through negotiation or mediation. Our experienced solicitors can assist you in reaching a fair agreement and formalising it through a legally binding court order.

Do I need to attend court for a civil partnership dissolution?

In most cases, civil partnership dissolutions are dealt with on paper without the need for a court appearance. However, if there are disputes over finances, property, or children, you may be required to attend hearings.

How long does it take to dissolve a civil partnership?

The process typically takes a minimum of 6 to 7 months, depending on the complexity of your case and the court’s timetable. If financial matters are involved, it may take longer to finalise everything.
